The Rooted Home Affiliate Program Terms and Conditions

Welcome to The Rooted Home Affiliate Program (the “Program”). These Terms and Conditions (the “Terms”) govern your participation in the Program. By enrolling, you agree to abide by these Terms.

1. Enrollment

• To join, you must complete the affiliate application form provided by Juniper Studio, LLC d/b/a The Rooted Home (the “Company”).
• We reserve the right to approve or reject any application at our sole discretion.

2. Unique Affiliate Discount Code

• Once accepted into the Program, you will be issued a unique discount code (the “Affiliate Code”).
• Affiliate Codes must be used as provided and may not be altered.
• All qualifying sales must be tracked through the Affiliate Code. No other tracking methods (such as cookies) will be used to calculate Commissions.

3. Commissions

• Affiliates will earn a commission based on the net sales (excluding taxes, shipping, returns, chargebacks, or discounts outside your Affiliate Code) generated through their Affiliate Code (the “Commission”).
• Unless otherwise specified by the Company, the applicable Commission will be 10% of all net sales generated through the Affiliate Code.
• The Company reserves the right to update Commission rates at any time with written notice, which updated rates shall only apply to those sales that occur after notice has been given to you.

4. Payouts

• Unless otherwise agreed by the parties, all payouts will be made via PayPal or Venmo.
• Minimum payout threshold: $25.00 USD. Monthly earnings below the threshold will roll over to the next payout period until the aggregate of all unpaid earnings exceeds $25.00.
• Payouts are made on a monthly basis, fifteen (15) days after the close of each period to account for returns and chargebacks.

5. Marketing Guidelines

• You may promote your Affiliate Code via your website, blog, social media, email newsletter, or other channels, provided they comply with these Terms.
• Prohibited Practices include:
• Misrepresenting The Rooted Home’s products or brand.
• Using spam, unsolicited emails, or misleading advertising.
• Bidding on branded keywords (e.g., “Rooted Home”), or their common misspellings, in paid search campaigns without the Company’s prior written permission.
• Posting Affiliate Codes on coupon websites or deal aggregator platforms without the Company’s prior written approval.
• Making self-referrals (i.e., purchases made by you, your immediate family, or the company that you work for). You will not receive Commissions on self-referrals.
• Engaging in any public conduct that could be construed as harmful to the Company’s reputation and brand, including, but not limited, to publicly disparaging the Company or its products.
• Affiliates must comply with all applicable laws, including the Federal Trade Commission’s (FTC) Endorsement Guides.

6. Intellectual Property

• You may use Company-approved logos, images, and marketing materials solely for promoting The Rooted Home as part of this Program.
• You may not alter, modify, or create derivative works of Company intellectual property without written permission.
• You are solely responsible for ensuring that your reviews, product descriptions and articles (if applicable at your site) obey all applicable copyright, trademark, and other laws. The Company will not be responsible if you use another party’s copyrighted or trademarked material in violation of the law.

7. Term and Termination

• Either party may terminate participation in the Program at any time, with or without cause, by providing written notice.
• Upon termination, all rights to use your Affiliate Code and the Company’s intellectual property will cease immediately.
• Commissions earned on qualifying sales prior to termination will still be paid, subject to these Terms. Accrued Commissions may be forfeited and relinquished if, in the Company’s sole determination, that such Commissions were earned through the use of any practices or methods similar to the Prohibited Practices outlined in Section 5 of these Terms, or other fraudulent, illegal, overly aggressive, or otherwise questionable sales or marketing methods.

8. Limitation of Liability

• The Company and any of the Company’s officers, directors, employees or agents, will not be liable for indirect, incidental, or consequential damages arising in connection with the Program.
• Our total liability under these Terms, whether in contract, tort (including negligence) or otherwise will not exceed the total Commissions paid to you in the six (6) month period immediately prior to the period giving rise to such claim.

9. Independent Contractor Relationship

• Participation in the Program does not create an employment, partnership, or agency relationship between you and The Rooted Home. You will have no authority to make or accept any offers or make representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Agreement.

10. Modification of Terms

• The Company reserves the right to update or modify these Terms at any time. Affiliates will be notified of changes, and continued participation constitutes acceptance of the modified Terms.

11. Governing Law

• These Terms will be governed by and construed under the laws of the State of Arizona, without regard to conflict of law principles.
